Welcome to Belugaro! These Terms of Service ("Terms") govern your access to and use of the Belugaro website (https://belugaro.com), Chrome browser extension, and related services (collectively, the "Services") operated by Belugaro ("we," "us," or "our").

By accessing or using our Services, you agree to be bound by these Terms. If you do not agree to these Terms, please do not use our Services.

1. Description of Services

Belugaro is a passive language learning platform that helps users learn vocabulary naturally while browsing the web. Our Services include:

  • Chrome Extension: Translates vocabulary words on any website, tracks your learning progress, and provides audio pronunciations
  • Web Dashboard: Displays your learning statistics, provides flashcard study sessions, and manages your account settings
  • Spaced Repetition System: Reviews vocabulary at optimal intervals to maximize retention

Supported Languages: English (source) to Spanish, French, German, Italian, and Portuguese (target languages).

2. Account Registration

2.1 Account Creation

To access certain features of our Services, you must create an account using Google OAuth authentication. You agree to provide accurate, current, and complete information during registration.

2.2 Account Responsibilities

You are responsible for:

  • Maintaining the security of your account credentials
  • All activities that occur under your account
  • Notifying us immediately of any unauthorized use of your account

2.3 Account Eligibility

You must be at least 13 years old (or 16 in the European Economic Area) to use our Services. By using our Services, you represent that you meet this age requirement.

3. Subscription Plans and Payments

3.1 Free and Paid Plans

Belugaro offers both free and paid subscription plans. Free users have access to limited features, while paid subscribers unlock the full functionality of our Services.

3.2 Payment Processing

All payments are processed through Stripe, our third-party payment processor. By subscribing to a paid plan, you agree to Stripe's terms of service. We do not store your full credit card information.

3.3 Subscription Terms

  • Billing Cycle: Subscriptions are billed monthly or as specified at the time of purchase
  • Automatic Renewal: Subscriptions automatically renew unless cancelled before the renewal date
  • Price Changes: We reserve the right to change subscription prices with 30 days' notice to existing subscribers

3.4 Cancellation

You may cancel your subscription at any time through your account settings or by contacting us. Cancellation will take effect at the end of your current billing period, and you will retain access to paid features until then.

4. Refund Policy

We offer a 7-day money-back guarantee for new subscriptions. If you are not satisfied with our Services, you may request a full refund within 7 days of your initial purchase by contacting us at zac@belugaro.com.

Refund conditions:

  • Refund requests must be made within 7 days of the original purchase date
  • The refund applies to the first payment only, not to subsequent renewal payments
  • Refunds are processed within 5-10 business days
  • No partial refunds are available for unused portions of subscription periods

5. License and Usage Rights

5.1 License Grant

Subject to these Terms, we grant you a limited, non-exclusive, non-transferable, revocable license to use our Services for your personal, non-commercial language learning purposes.

5.2 Restrictions

You agree NOT to:

  • Copy, modify, distribute, or create derivative works of our Services
  • Reverse engineer, decompile, or disassemble any part of our Services
  • Use automated scripts or bots to access our Services
  • Circumvent any access restrictions or usage limits
  • Share your account credentials with others
  • Use our Services for any illegal or unauthorized purpose
  • Interfere with or disrupt the integrity or performance of our Services
  • Attempt to gain unauthorized access to our systems or networks

6. Chrome Extension Terms

6.1 Browser Permissions

Our Chrome extension requires certain browser permissions to function. By installing the extension, you consent to these permissions as described in our Privacy Policy.

6.2 Website Interaction

The extension modifies web page content to display translations. We are not responsible for any issues caused by interaction between our extension and third-party websites. Some websites may not be compatible with our extension.

6.3 Updates

The extension may update automatically through the Chrome Web Store. These updates may change functionality, fix bugs, or add new features.

7. Intellectual Property

7.1 Our Content

All content, features, and functionality of our Services—including but not limited to text, graphics, logos, icons, images, audio clips, digital downloads, data compilations, and software—are owned by Belugaro or our licensors and are protected by copyright, trademark, and other intellectual property laws.

7.2 Vocabulary Content

The vocabulary translations and language learning content provided through our Services are for your personal learning use only and may not be extracted, redistributed, or used for commercial purposes.

7.3 Your Content

You retain ownership of any content you submit through our Services (such as feedback or support messages). By submitting content, you grant us a non-exclusive, worldwide, royalty-free license to use, reproduce, and display such content for the purpose of providing and improving our Services.

8. User Conduct

You agree to use our Services in a manner that:

  • Complies with all applicable laws and regulations
  • Respects the rights and dignity of others
  • Does not harass, abuse, or harm others
  • Does not transmit viruses, malware, or other malicious code
  • Does not attempt to probe, scan, or test the vulnerability of our systems

9. Third-Party Services and Content

Our Services integrate with third-party service providers for authentication, payment processing, and other functionality as described in our Privacy Policy. Your use of these services is subject to their respective terms and privacy policies. We are not responsible for the practices of these third parties.

Our extension operates on third-party websites. We are not responsible for third-party website content, availability, or changes that may affect extension functionality. Third-party websites are not under our control and may change without notice.

10. Disclaimers

10.1 Service Availability

Our Services are provided "as is" and "as available" without warranties of any kind, either express or implied. We do not guarantee that our Services will be uninterrupted, error-free, or free of viruses or other harmful components.

10.2 Learning Outcomes

While we strive to provide effective language learning tools, we do not guarantee specific learning outcomes. Language learning results vary based on individual effort, usage patterns, and other factors outside our control.

10.3 Translation Accuracy

While we strive for accuracy, vocabulary translations are provided for educational purposes and may not be suitable for professional translation needs. We do not guarantee the accuracy of all translations.

10.4 No Professional Advice

The Services are provided for personal educational purposes only and do not constitute professional, academic, or certification advice. Our Services are not a substitute for formal language instruction or professional translation services.

10.5 Service Modifications

We reserve the right to modify, suspend, or discontinue any part of the Services at any time, with or without notice. We may also impose limits on certain features or restrict access to parts or all of the Services without notice or liability.

11. Limitation of Liability

To the maximum extent permitted by applicable law, Belugaro and its officers, directors, employees, and agents shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, data, use, or goodwill, arising out of or in connection with your use of our Services.

We are not responsible for loss of user data, learning progress, or content, although we make reasonable efforts to maintain system reliability and data integrity. You are encouraged to maintain your own records of important information.

Our total liability for any claims arising from these Terms or your use of our Services shall not exceed the amount you paid to us in the twelve (12) months preceding the claim.

12. Indemnification

You agree to indemnify and hold harmless Belugaro and its officers, directors, employees, and agents from any claims, damages, losses, or expenses (including reasonable legal fees) arising from your use of our Services or violation of these Terms.

13. Termination

13.1 Termination by You

You may terminate your account at any time by contacting us at zac@belugaro.com. Upon termination, your right to use our Services will immediately cease.

13.2 Termination by Us

We may suspend or terminate your access to our Services at any time, with or without cause, and with or without notice. Reasons for termination may include violation of these Terms, fraudulent activity, or extended periods of inactivity.

13.3 Effect of Termination

Upon termination, your license to use our Services ends, and we may delete your account and associated data in accordance with our Privacy Policy. Sections of these Terms that by their nature should survive termination shall survive.

14. Changes to Terms

We may update these Terms from time to time. When we make material changes, we will:

  • Update the "Last Updated" date at the top of this page
  • Notify registered users via email for significant changes
  • Provide notice through our Services

Your continued use of our Services after changes become effective constitutes your acceptance of the revised Terms.

15. Governing Law and Dispute Resolution

15.1 Governing Law

These Terms shall be governed by and construed in accordance with the laws of the Province of British Columbia and the federal laws of Canada applicable therein, without regard to conflict of law provisions.

15.2 Dispute Resolution

Any disputes arising out of or relating to these Terms or our Services shall first be attempted to be resolved through good-faith negotiation. If negotiation fails, disputes shall be resolved through binding arbitration conducted in British Columbia, Canada, in accordance with Canadian arbitration laws. Arbitration may occur remotely at the mutual agreement of both parties. This arbitration agreement does not prevent you from bringing claims in a small claims court of competent jurisdiction.

16. General Provisions

16.1 Entire Agreement

These Terms, together with our Privacy Policy, constitute the entire agreement between you and Belugaro regarding your use of our Services.

16.2 Severability

If any provision of these Terms is found to be unenforceable, the remaining provisions will continue in full force and effect.

16.3 Waiver

Our failure to enforce any right or provision of these Terms shall not constitute a waiver of such right or provision.

16.4 Assignment

You may not assign or transfer these Terms or your rights hereunder without our prior written consent. We may assign these Terms without restriction.

16.5 Force Majeure

We shall not be liable for any failure or delay in performing our obligations under these Terms resulting from events beyond our reasonable control, including but not limited to: natural disasters, government actions, internet or infrastructure outages, third-party service provider failures, cyberattacks, or other circumstances beyond our reasonable control.
